Welcome to BetaTesting Hub ("the App") operated by BetaTesting Hub ("we", "us", or "our"). Please read these Terms & Conditions ("Terms") carefully before using our App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of the Terms, do not use the App.
1. Definitions
"App" means the mobile application named BetaTesting Hub and all associated services. "User" or "you" means any person who downloads, accesses, or uses the App.
2. Acceptance of Terms
By downloading, installing, or using the App, you accept and agree to be bound by these Terms, our Privacy Policy located at https://betatestinghub.com/privacy-policy, and any additional terms and conditions that may apply to specific features of the App.
3. Changes to Terms
We may modify these Terms at any time. When we make changes, we will update the "Effective date" above. Continued use of the App after changes constitutes acceptance of the updated Terms.
4. Eligibility
Our platform doesn't have any age restrictions meaning to say anyone can access our platform regardless of his age.
5. Account Registration
Certain features may require you to register an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
6. License & Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes. You may not:
- Copy, modify, distribute, sell, or lease any part of our App;
- Reverse engineer, decompile, or attempt to extract source code from the App;
- Use the App to transmit illegal, harmful, infringing, or offensive content;
- Interfere with the operation of the App or any user’s enjoyment of the App.
7. Payments, Subscriptions & Refunds
If the App offers paid features, you agree to pay all applicable fees and taxes. Payment terms are processed through our third-party payment provider and are subject to their terms. Refunds (if any) will be handled according to our Refund Policy, which is available within the App or at our support email.
8. Intellectual Property
All rights, title and interest in and to the App, including all software, designs, text, graphics, logos, and trademarks, are owned by us or our licensors. Nothing in these Terms grants you any ownership rights in the App.
9. User Content
If you submit, post, or display any content in the App ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, display and perform that content in connection with the App. You represent and warrant that you own or have the necessary rights in any User Content you provide.
10. Prohibited Conduct
You must not use the App to:
- Violate any applicable law or regulation;
- Infringe any third party's intellectual property or privacy rights;
- Upload viruses, malware, or other harmful code;
- Harvest or collect personal data about other users without their consent.
11. Third-Party Links & Services
The App may contain links to third-party websites and services that are not owned or controlled by us. We do not endorse or assume any responsibility for third-party content or practices. Your interactions with third parties are at your own risk.
12. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall BetaTesting Hub or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or USD 100 if you paid nothing.
14. Indemnification
You agree to indemnify and hold harmless BetaTesting Hub, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs or debt arising from your violation of these Terms or your use of the App.
15. Termination
We may suspend or terminate your access to the App for violation of these Terms or for any other reason. Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination will continue to apply.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms shall be resolved in the courts located in Dombotombo Marondera Zimbabwe, and you consent to the personal jurisdiction of those courts.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and BetaTesting Hub concerning the App.
